Refund policy

  1. RETURNS AND REFUNDS

10.1 This clause is in addition to and not in substitution for any other right in law between Fluffy Bunny Tactical and the User to return the Goods and receive a refund;


10.2 Subject to clauses 10.3 to 10.6 below, the User may return the Goods to Fluffy Bunny Tactical and receive a full refund of any consideration paid for the Goods, if Fluffy Bunny Tactical has delivered Goods intended to satisfy a particular purpose communicated to Fluffy Bunny Tactical and if within 7 (seven) Business Days after delivery to the User, the Goods have been found to be unsuitable for that particular purpose;


10.3 Clause 10.2 above does not apply with respect to any Goods, if after having been supplied to, or at the direction of the User:


10.3.1 For reasons of public health or otherwise, a public regulation prohibits the return of those Goods to Fluffy Bunny Tactical once they have been supplied to, or at the direction of, the User; or


10.3.2 The Goods have been worn, partially or entirely disassembled, physically altered, joined or added to, blended or combined with, or embedded within, other Goods or property.


10.4 Goods returnable in terms of clause 10.2 above must be returned to Fluffy Bunny Tactical at the User’s risk and expense, within 7 (seven) Business Days after delivery to the User;


10.5 Upon return of any Goods in terms of this clause, Fluffy Bunny Tactical must refund to the User the Price paid for the Goods, less any amount that may be charged in terms of clause 10.7 below, after having been afforded an opportunity to inspect the Goods returned;


10.6 In determining the right of Fluffy Bunny Tactical to impose a charge contemplated in clause 10.5 above, if any Goods returned to Fluffy Bunny Tactical in terms of this clause are:


10.6.1 In the original unopened packaging with all tags and labels attached, Fluffy Bunny Tactical may not charge the User any amount in respect of the Goods;


10.6.2 In their original condition and repackaged in their original packaging, Fluffy Bunny Tactical may charge the User a reasonable amount for:


– Use of the Goods during the time they were in the User’s possession, unless they are Goods that are ordinarily consumed or depleted by use, and no such consumption or depletion has occurred; or


– Any consumption or depletion of the Goods, unless that consumption or depletion is limited to a reasonable amount necessary to determine whether the Goods were acceptable to the User; or

10.6.3 In any other case, Fluffy Bunny Tactical may charge the User a reasonable amount:


– As contemplated in clause 10.6.2 above; and


– For necessary restoration costs to render the Goods fit for re-sale, unless, having regard to the nature of the Goods and the manner in which they were packaged, it was necessary for the User to destroy the packaging in order to determine whether the Goods were fit for the intended purpose.


10.7 Goods may be returned to Fluffy Bunny Tactical in the following manner:


10.7.1 Directly to the Fluffy Bunny Tactical Store by the User; alternatively


10.7.2 By delivery via Courier to the Fluffy Bunny Tactical Store.


10.8 When returning Goods to the Fluffy Bunny Tactical Store directly, the User shall follow the usual in-store return process applied by Fluffy Bunny Tactical and the User will be required to:


10.8.1 Furnish proof of purchase (invoice or delivery note); and


10.8.2 Produce the card (proof of payment) utilized (credit, cheque or debit card) to effect payment for the Goods purchased.


10.9 When returning Goods via the Courier, the User will be required to:


10.9.1 Supply a reference number from the courier company


10.9.2 Insert the Goods into appropriate packaging to ensure that the Goods are not damaged during transportation;


10.9.3 Make the duly packaged Goods available for collection by the Courier in accordance with the instructions received from Fluffy Bunny Tactical.


10.10 Refund of returned Goods shall occur as follows:


10.10.1 EFT payments will be refunded to customer via EFT.


  1. ERRORS

11.1 Fluffy Bunny Tactical shall take all reasonable efforts to accurately reflect the description, availability and purchase price of Goods on the Website. However, should there be any errors of whatsoever nature on the Website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding the User for any amount already paid, or otherwise as set out in clause 10 above.


  1. DISCOUNTED GOODS

12.1 From time to time, Fluffy Bunny Tactical may offer certain Goods at discounted prices (“Deal”). These will be subject to certain conditions which define the scope of the Deal. If you buy a product within the scope of a Deal, you will pay the discounted price for that Goods (the “Deal Price”).


12.2 However, if you buy Goods in a manner that falls outside of the scope of a Deal, then you will pay the then current (non-Deal) selling price on the Website (the “Normal Price”), for each product that falls outside the scope of the Deal.


  1. CUSTOMER’S RIGHTS TO SAFE, GOOD QUALITY PRODUCTS

13.1 The Parties agree in respect of the sale of all Goods by Fluffy Bunny Tactical, that the User:


13.1.1 Has been expressly informed that the particular Goods were offered in a specific condition; and


13.1.2 Has expressly agreed to accept the Goods in that condition, or knowingly acted in a manner consistent with accepting the Goods in that condition.


  1. IMPLIED WARRANTY OF QUALITY

14.1 The implied warranty contained in section 56 of the CPA shall not apply to the Goods sold to the User due to the fact that Fluffy Bunny Tactical is deemed to have clearly and expressly stated the condition in which the Goods are sold to the User and the User is deemed to have indicated.


14.1.1 That he/she expressly agrees to the Goods being sold in the aforesaid condition; and has not specifically informed Fluffy Bunny Tactical of any particular purpose for which he/she wishes to acquire or use the Goods.


14.2 Although Goods sold from the Website may, under certain specifically defined circumstances, be under warranty, the Website itself and all information provided on the Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.


  1. LIABILITY FOR DAMAGE CAUSED BY GOODS

15.1 Except to the extent contemplated in clause 15.3 below, the producer, importer, distributor or retailer of the Goods, including Fluffy Bunny Tactical, are liable for any harm, caused wholly or partly as a consequence of:


15.1.1 Supplying any unsafe Goods;


15.1.2 A Product failure, defect or hazard in any Product; or


15.1.3 Inadequate instructions or warnings provided to the User pertaining to any hazard arising from or associated with the use of the Goods, irrespective of whether the harm resulted from any negligence on the part of the producer, importer, distributor, or Fluffy Bunny Tactical, as the case may be.


15.2 If, in a particular case, more than one person is liable in terms of this clause, their liability is joint and several;


15.3 Liability of Fluffy Bunny Tactical in terms of this clause does not arise if:


15.3.1 The unsafe Product characteristic, failure, defect or hazard that results in harm is wholly attributable to compliance with any public regulation;


15.3.2 The alleged unsafe Product characteristic, failure, defect or hazard:


  1. a) Did not exist in the Product at the time it was supplied by Fluffy Bunny Tactical to the User; or


  1. b) Was wholly attributable to non-compliance by the User with instructions provided by Fluffy Bunny Tactical, in which case point (a) above does not apply.


15.3.3 It is unreasonable to expect Fluffy Bunny Tactical to have discovered the unsafe Product characteristic, failure, defect or hazard, having regard to Fluffy Bunny Tactical’s role in marketing and supplying the Goods to the User; or


15.3.4 The User’s claim for damages is brought more than 3 (three) years after the:


  1. a) Death or injury of a person;


  1. b) Earliest time at which a person had knowledge of the material facts about an illness; or


  1. c) Earliest time at which a person with an interest in the Goods had knowledge of the material facts about the loss or damage to that Goods; or


  1. d) The latest date on which the User suffered any related economic loss.


15.4 The User acknowledges that Fluffy Bunny Tactical shall have no responsibility or liability of any kind, whether for breach of warranty or otherwise arising or resulting from:


15.4.1 Malfunction, failure or unavailability of the Goods to the extent that Fluffy Bunny Tactical has maintained industry accepted standards typically associated with the Goods;


15.4.2 Errors in the functioning of the Goods resulting from abuse, negligence, improper or inappropriate use of all or any part of the Goods by the User;


15.4.3 A failure to supply the Goods to the extent that such failure is due to any default, delay, act or omission of the User or as a result of the User’s third-party dependencies beyond the control of Fluffy Bunny Tactical.
